Introduction

Alberk Proses (“Alberk”, the “Company”, or “we”) attaches great importance to the lawful processing and protection of its customers’ personal data.

This Data Protection Privacy Notice (the “Privacy Notice”) has been prepared in accordance with Article 10 of Law No. 6698 on the Protection of Personal Data (the “Law”) and the European Union General Data Protection Regulation (“GDPR”) in order to provide transparent information regarding the processing of the personal data of customers who purchase products or machinery, place orders, or carry out similar transactions through our sales offices, exhibition stands, or sales and marketing departments.

In this Privacy Notice, we, as ALBERK in our capacity as data controller, provide information regarding the categories of personal data we process, the purposes for which such data is processed, the third parties with whom your data may be shared, your rights in relation to your personal data, and the methods by which you may contact us.

How Do We Collect Your Personal Data and What Is the Legal Basis for Processing?

Your personal data may be collected directly from you through our sales offices, exhibition stands, and sales and marketing departments when you purchase products, place orders, or carry out similar transactions through these channels. Such data may be collected through printed documents and/or our electronic systems.

Under the Law, personal data may only be processed where at least one of the conditions specified in the Law applies. Regardless of the purpose for which ALBERK processes your personal data, we process such data in accordance with applicable national and international legislation, particularly the fundamental principles set forth in Article 4 of the Law, and on the basis of the personal data processing conditions specified in Articles 5 and 6 of the Law.

Accordingly, ALBERK may process its customers’ personal data where:

i) processing is expressly provided for by law;

ii) processing is directly related to the establishment or performance of a contract, including the manufacture of products, performance of services, or provision of related services;

iii) processing is necessary for compliance with our obligations under applicable national and international legislation; and

iv) processing is necessary for our legitimate interests, provided that such processing does not adversely affect the fundamental rights and freedoms of our customers.

In addition to these legal grounds, we may, in certain circumstances, request your explicit consent to process your personal data. In such cases, your personal data will be processed only within the scope of the explicit consent you have freely provided. You have the right to withdraw your explicit consent at any time.

What Personal Data Do We Process?

General information regarding the categories of personal data processed by ALBERK is provided below. Identity and Contact Information: Personal data such as your name, surname, identification number, passport information, and similar information provided when creating an account, ordering machinery, or applying for special services offered by ALBERK and its business partners, as well as your email address, telephone number, mobile phone number, social media contact information, address, and similar contact details.

Customer Information: Call center records, invoices, promissory note and cheque information, information contained in bank receipts, order information, request information, and similar records.

Physical Premises Security Information: Entry and exit records of employees and visitors and CCTV recordings.

Health Information: PCR tests and related test information required for international travel or entry into a country.

Feedback and Requests: Information relating to evaluations, feedback, requests, and comments you provide regarding our services.

Payment Information: Credit/debit card information, bank account information, IBAN details, balance information, outstanding receivables, and other financial information.

Special Categories of Personal Data: Where requested by you and subject to your approval, information concerning special parts, documents, or other specific requirements necessary for the provision of services you may require during the machinery manufacturing process.

Marketing Information: Reports and evaluations concerning customers’ habits and preferences for marketing purposes, targeting information, cookie records, information derived from data enrichment activities, surveys conducted with individuals, customer satisfaction surveys, campaigns, and information and assessments obtained through direct marketing activities.

For What Purposes Do We Process Your Personal Data?

ALBERK processes your personal data for the purposes described below. For further information regarding the purposes for which your personal data is processed, you may review the Alberk Proses Makineleri Personal Data Protection and Processing Notice available through the VERBIS system.

Operations, Transportation, Logistics and Other Related Services: Conducting preliminary discussions and meetings; obtaining and providing detailed information regarding products in accordance with your requests; processing order information; and carrying out routine operational activities relating to transportation, installation, after-sales services, campaigns, training, and other services associated with the manufactured product.

Communications: Contacting you via SMS, email, or telephone to provide order information, confirm product purchases, and communicate payment or product-related information. Please note that communications which do not contain marketing content and are sent solely for the purposes described above or for similar service-related notifications are not subject to prior consent pursuant to Article 6 of the Regulation on Commercial Communication and Commercial Electronic Messages and may therefore be sent by ALBERK even if you have not provided consent to receive marketing communications.

Evaluation of Your Requests and Feedback: Collecting customers’ opinions, complaints, feedback, and evaluations regarding our services through written or online forms and surveys; assessing such feedback; and arranging the delivery of gifts within the scope of customer satisfaction activities.

Legal Obligations: Ensuring ALBERK’s compliance with applicable national and international legislation and fulfilling obligations arising from such legislation.

Service Personalization: Customizing, recommending, and promoting programs, services, and products according to the preferences and usage habits of the relevant individuals.

To Whom and for What Purposes Do We Transfer Your Personal Data?

Personal data processed by us may, under certain circumstances, be transferred to third parties located within Türkiye or abroad in accordance with applicable national and international legislation, particularly Articles 8 and 9 of the Law.

Third parties to whom your personal data may be transferred include:

Domestic and International Travel-Related Service Providers: Ground handling service providers at airports, travel agencies, Global Distribution Systems (GDS), airlines operating certain segments of connecting journeys, and similar service providers.

Suppliers and Service Providers: Software companies from which we receive technical support, security service providers, transportation service providers, and similar suppliers.

Authorized Institutions and Authorities: Foreign governmental authorities in countries to which products are shipped, private institutions and organizations authorized under national or international legislation, and competent public authorities, including, for example, law enforcement authorities in connection with investigations and the U.S. Department of Homeland Security where applicable to shipments to the United States.

Information Regarding Commercial Electronic Communications

Pursuant to Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, and subject to the consent you have provided, your personal data may be processed for the purposes of providing information about our services, promoting our goods and services, and informing you about our campaigns and promotions.

What Rights Do You Have as a Data Subject?

Pursuant to Article 11 of the Law, you have the right to:

  • learn whether your personal data is being processed;

  • request information regarding such processing if your personal data has been processed;

  • learn the purposes for which your personal data is processed and whether it is being used in accordance with those purposes;

  • learn the identity of third parties located within Türkiye or abroad to whom your personal data has been transferred;

  • request the correction of incomplete or inaccurate personal data and request that such correction be communicated to third parties to whom your personal data has been transferred;

  • request the deletion or destruction of your personal data where the reasons requiring its processing no longer exist and request that such action be communicated to third parties to whom your personal data has been transferred;

  • object to any adverse outcome resulting from the analysis of your personal data exclusively through automated systems; and

  • claim compensation if you suffer damage as a result of the unlawful processing of your personal data.

Applications are generally processed free of charge. However, where the processing of an application incurs additional costs, a fee may be charged in accordance with the tariff determined by the Personal Data Protection Board.
